These Terms and Conditions of Use (the “Terms of Use”) apply to the website https://cgfasttrack.com (the “Site”) which consists of various web pages and associated sites operated by CG Fast Track LLC (“CGFT”), a California Limited Liability Company. The Site is the sole and exclusive property of CGFT and its licensors, if any.

BY ACCESSING OR USING THIS SITE IN ANY WAY, INCLUDING USING ANY SERVICES, SUBSCRIBING TO THE SERVICES, DOWNLOADING OR PURCHASING MATERIALS, OR MERELY BROWSING THE SITE, YOU AGREE TO AND ARE BOUND BY THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SITE.

CGFT reserves the right, at its sole discretion, to change, modify, add or remove portions of the Terms of Use, at any time. Your access and use of the Site, Services or Materials (defined hereinbelow) will be subject to the most current version of the Terms of Use  at the time of such use. Please regularly check the “Terms of Use” link on the homepage of the CGFT website.  If you breach any of the Terms of Use, your authorization to access or use this Site, Services, or Materials, automatically terminates, and any Materials downloaded or printed from the Site in violation of the Terms of Use must be immediately destroyed.

The Site is an online educator / online community / e-commerce website offering paid products and services (Materials and Services), in addition to offering an online community where people from around the world can interact and learn from one another.

CGFT does not knowingly collect, either online or offline, personal information from persons under the age of sixteen.  If you are under the age of 18, you may use the Site only with the permission of a parent or guardian. Except as expressly provided in these Terms of Use, no part of the Site may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise unless you have prior written approval from the President of CGFT.

As long as you comply with these Terms of Use, CGFT grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

The Site, Materials, and Services, Intellectual Property and Prohibited Use
The Site consists of Materials and Services as well as an online chat community.  “Materials” means all information, text, graphics, user interfaces, visual interfaces, photographs, names, images, trademarks, logos, sounds, music, artwork, and computer codes, data, tutorials, communications, downloads, instructions, files, photographs, graphics, videos, webcasts, publications, content, tools, resources, models, assets, source code, software, code, programs, and products made available or enabled via the Site by CGFT or users of this Site, including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement or presentation of such Materials.

“Services” means all services and resources offered or enabled via the Site by CGFT and users of this Site, including without limitation, download areas, instructional tools and videos, developer tools and services, product or other information services, courses, communications services such as commenting in the online community or in communications to and from our instructors, bulletin boards, calendars, chat areas, communities, email, forums (including lab and user to user forums), newsgroups, personal webpages, photo albums, and other message or communication facilities designed to enable you to communicate with others via this Site.

The Site, Materials, and Services, as well as their selection and arrangement, instructor’s expressions and creations, and the courses, are all owned and controlled by CGFT, or licensed by third parties to CGFT, and are protected by copyrights, trademarks, patents, trade secrets and all other intellectual property, unfair competition, and proprietary rights (collectively, “Intellectual Property Rights”), and any unauthorized use of the Materials or Services may violate such laws and the Terms of Use.

You further agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, lend, distribute, display, perform, license, sublicense or reverse engineer the Site, Materials, Services (including courses) or the Intellectual Property (including courses), any portions of the Site, Materials, or Services, or the selection and arrangement of the Site, Materials, or Services, except as expressly authorized herein. In addition, you agree not to use any data mining, robots or similar data gathering and extraction methods in connection with the Site, Materials, or Services.

By use of this Site (as well as any subscriptions thereto), you are granted a non-exclusive, non-transferable, revocable limited license to access and use https://cgfasttrack.com strictly in accordance with these Terms of Use. As a condition of your Use of the Site you warrant and represent to CGFT that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any Materials or information through any means not intentionally made available or provided for through this Site. 

For the avoidance of doubt, CGFT does not own and is not liable for the media or content uploaded by Members on this website and/or the Network’s websites, unless specifically created, displayed and/or uploaded by CGFT.

By use of this Site (as well as any subscriptions thereto), you agree you will not resell any portion of the Site, the Materials, the Services, (including the courses) or in any way exploit any of the content, in whole or in part, found on the Site. CGFT content, including any part of the Site, is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content with out the express prior written permission of CGFT and the copyright owner. You agree that you do not acquire any ownership rights in any protected content.  We do not grant you any licenses, express or implied, to the intellectual property of CGFT or our licensors, except as expressly authorized in these Terms. 

Licensed Software
CGFT uses only properly licensed software which is shown for educational purposes via instruction on the Site, in the Materials and in the Services (including courses). All software is owned and licensed by its respective operators and owners. CGFT is not the owner of this software and is not licensed to issue licensed software to the users.  You must obtain licensed software on your own in order to access the platforms and software referenced on this Site.  CGFT expressly disclaims issuance of software rights and urges you to obtain licensed software before accessing the Site, the Materials or the Services (including courses).  Similarly, products represented as models on the Site or used in Courses may not be owned by CGFT or may not be registered to CGFT and CGFT does not offer these products or models for sale. CGFT expressly disclaims that any such model or product has any similarity to any product of a similar nature on the market.

Downloading Materials
Downloadable Materials will be made available to subscribers of the Site. These Materials are provided for educational purposes only.  Downloading of video or step-by-step screenshot content is not allowed.  You may not distribute any of the Materials, including downloadable content provided. Downloadable Materials are not to be distributed, published, or sold.

Refund Policy
You may request a refund within thirty (30) days of the first time you gain access to the CGFT course library.  Watching over 50+ videos will void your ability to receive a refund. Downloading three (3) or more course files will void your ability to receive a refund. If you request a refund,  your access to the Site will terminate immediately. Please see further details as to our Subscriptions and Lifetime Membership Cancelations below. Refunds do not happen automatically upon cancelation or for any reason; they only occur upon request.

Student Software Discounts
CGFT is not liable for access to student software discounts and does not provide these discounts directly; CGFT does not control the software or if the software company decides to revoke software discounts available to students, and CGFT will not be liable under any circumstance for failure to provide or revocation of a student software discounts.

Not One-on-One Mentoring
Because we have thousands of members, CGFT cannot guarantee one-on-one mentoring to any subscriber or user of the Site. When making purchases on the Site, you are purchasing Materials and Services, which are access to the courses and content themselves; you are not purchasing direct one-on-one mentoring. Any questions our team or instructors answer is solely up to their discretion. We do not guarantee any of your educational-related questions will be answered. CGFT is a self-learning environment.

Monthly and Yearly Subscriptions
We offer monthly and yearly subscriptions, which gains you access to the Site, Materials, and Services so long as you have paid for access to the Site. Monthly and Yearly subscriptions are set to automatically renew. You may cancel your subscription at any time prior to your renewal date. Cancellations after your renewal will not be eligible for a refund for that month or year’s renewal.

Lifetime Membership
We offer a Lifetime Membership, which gains you access to all courses under Cgfastrack.com for as long as we host our Site. If we decide later to not host the Site any further, we will provide a downloadable link to the courses and course content (Materials) for up to one year after the website is taken offline. The Lifetime Membership applies only to the www.cgfasttrack.com website; We may build other websites under different domains that may also have Materials and courses that we do not make available on the www.cgfasttrack.com website, and the Lifetime Membership does not apply to those different domains and the content therein.

Lifetime Membership Monthly Payments
In order to access the Site, Materials, and Services (including the courses), you must pay consistently and consecutively every month on a month-to-month basis. Failed payments for any reason may result in termination of access to the Site and termination of your Membership. One or more failures to comply with these terms may result in immediate termination of your Membership. We do not support pausing monthly payments for excessive amounts of time. Not complying with these terms may result in payments being voided. Previous payments are not included if you choose to return.

Lifetime Discounts for Monthly and Yearly Subscriptions
Discounts are void if you cancel your subscription.  We reserve the right to stop hosting the website and providing Materials, products, or Services at any time. If this happens, we will provide you with a downloadable link to the courses available for up to one year or until your paid subscription billing period has ended, whichever is first.

Subscription to Lifetime Membership Transition Upgrade
Until Aug 31st, 2021, we offered our members the ability to upgrade and credit all of their previous subscription payments toward a Lifetime Membership. Cancelling a subscription voids all progress applicable toward any Lifetime Membership. You must contact support@cgfasttrack.com within 30 days of paying in full and request that we credit your processed subscription payments in the form of a credit to or refund for your Lifetime Membership. Subscription payments in excess of a Lifetime Membership are void and are not reimbursable or applicable for this credit or upgrade.

Subscriptions Cancellations
To cancel a subscription, you must go to the Site and into your account settings and directly indicate your intent to cancel the subscription. In the rare occasion you cannot access the Site in order to cancel your subscription, you may indicate your cancellation by requesting so from our team at support@cgfasttrack.com. As of February 11, 2021, Subscription cancellation will void all progress on payments that would otherwise be considered eligible towards the Lifetime Membership. It is your responsibility to cancel the subscription before your auto-renewal date.

Lifetime Membership Cancellations
Upon joining the CGFT Lifetime Membership, you are committing to paying the full six (6) monthly payments or the full one-time payment.  Under extreme circumstances entirely in the discretion of CGFT, we will potentially permit a cancellation of these recurring payments. You will lose access immediately upon cancellation. If you decide to re-subscribe, any previous payments will not be considered applicable towards your Membership. You will not be eligible to re-subscribe with the monthly plan option upon cancellation. If you choose to return after cancellation, you must pay the fee in full.  Monthly payments are in the discretion of CGFT and may be revoked for insufficient funds or other failed payments.

Course Release Dates
New course release dates are not guaranteed to be released on specific dates or by specific times. Release dates will fluctuate based on course length, instructor availability, and other variables in place of course creation.  We are fully transparent about release dates for already developed and released Materials, Services and courses, and urge you to consider this when making your purchase decisions. We promoted release schedules during the “early access special subscription” sale, from the period of April 5, 2020 through August 18, 2020 as being an average of two new courses a month. We have successfully released 11 courses during this time, roughly an estimated average of 2.4+ courses a month.  This release schedule is not to be expected post August 18, 2020, which marks the end of the early access subscription sale phase.  Release dates may be modified, altered, or postponed based on factors within the discretion of CGFT.

New Course Releases
Will there be a new course released every month forever? No. The Blender Track will include 30+ courses. We do not believe in creating excessive amounts of content. Similar to a school, our content will be finite. We choose quality over quantity. How long before each new course? The release dates will vary. It will take many, many months to complete all 30+ courses for the Blender Track.

‍Community Area Liability Limitations
The Community areas of the Site are provided in the discretion of CGFT and may be discontinued at any time.  We do not accept liability for the actions or statements of anyone within our community areas.  We are not responsible for the statements made by users in the community area, and we do not endorse or affiliate ourselves with any such statements unless explicitly stated as having come from CGFT officers, and then only in writing signed by the officer. We do, however, have a list of ground rules for all of our community areas, including: while using our Network, the Site, the Materials, the Services (including online communities and posts):
• Be courteous and respectful of opinions and feelings of others. Use of this website is a privilege not a right.  
• Harassment of other members will not be tolerated and may result in an instant termination or suspension of your account including limitations to access of the Site, the Materials, the Services (including the courses, in CGFT’s sole discretion.
• Do not send any unsolicited or unauthorized advertising, promotional materials, email, junk mail (e.g. spam), chain letters, or other forms of solicitation.
• This is not a political forum. It is a community of like-minded individuals who have come together to share information and exchange ideas.  Please be mindful of other’s experiences and information.
• Do not violate any applicable law, statute, or regulation.
• Defamation will not be tolerated.
• Do not impersonate or misrepresent your affiliation with any person or entity. 
• Do not attempt to probe or attempt malicious attacks against CGFT’s servers, infrastructure, and/or websites (including this Site and websites on the Network).
• Follow all rules and regulations posted in community areas. 
• No vulgar or obscene language.
• No hate speech.
• No derogatory comments about others.

‍Not adhering to these ground rules could result in immediately removal of your account without notification.

Contests
From time to time, we may offer contests with various non-cash prizes. The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash, or exchangeable for any other prize. All prizes must be redeemed within 30 days of the contest end date unless otherwise stated in the contest’s official rules. CGFT reserves the right to determine an alternate winner or to not award that winner’s prize, in CGFT’s sole discretion.

International Users
The Site is controlled, operated and administered by CGFT from our offices within the USA. If you access the Site from a location outside the USA, including any websites on our Network, you are responsible for compliance with all local laws. You agree that you will not use the CGFT Content accessed through https://cgfasttrack.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Software Issues
Official CG Fast Track Support can not help with specific software issues and questions, like installations, missing files, common software bugs, and other issues. If you are experiencing issues, use the official help forums. Premium Members may also join our community areas, forum, and Discord, where our community members often help each other.

Not a do it for your service
When purchasing a CG Fast Track membership, you are not buying our team members' or instructors' time to help fix your personal, professional, course-related, or any other types of projects. Our support email is for customer service-related topics such as logins, payment issues, etc.

Individual Use Only
Each member's login can only be used by one person. The memberships and logins are not transferable.

Multi-User and Team License
When purchasing a multi-user license, you opt out of any community area benefits, including the Discord. You may still access the Q and A forum to see commonly asked questions. This does not give you the ability to post new questions.

Professional Team Support
When purchasing a multi-user and team license, the company and everyone utilizing the license must agree to our Terms of Use and Privacy Policies. A special reminder: you are not hiring a CG Supervisor to work directly with your team when purchasing our membership.

Disclaimer of Representations and Warranties
The Services and Content, and all materials, information, products and services included therein, are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. Your use of the Services and Content is at your sole discretion and risk.

Purchasing Decision
You should perform your own due diligence prior to making any purchase from us. By virtue of visiting this Site or interacting with any portion of this Site and related companies, you agree that you are fully responsible for the investments and purchases you make and YOU RELEASE CGFT AND ITS PRINCIPALS, OFFICERS, HEIRS AND ASSIGNS FROM ANY CLAIMS OF ILLEGALITY. Termination/Access Restrictions
CGFT reserves the right, in its sole discretion, to terminate your access to the Site and the related Materials, Services (including courses), or any portion thereof at any time, without notice.  To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles California in all disputes arising out of or related to the use of the Site, these Terms, or the information, software, Materials and Services included herein.  Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms of Use, including, without limitation, this section.

You agree that no joint venture, partnership, employment or agency relationship exists between you and CGFT as a result of this agreement, use of the Site, or access to the information, software, Materials and Services (including the courses). CGFT’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of CGFT’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by CGFT with respect to any such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty and disclaimers and liability limitations above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and CGFT with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and CGFT with respect to the Site. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms
CGFT reserves the right, in its sole discretion, to change or modify these Terms. The most current version of the Terms will supersede all previous versions. CGFT encourages you to periodically review the Terms to stay informed of our updates.
